These terms govern approved access to the Failsafe closed beta at failsafe.asta.cx. Failsafe is a cloud observability service published under Asta. By using an approved beta account, you agree to these terms.
1. Beta access
Failsafe is experimental software in a closed beta. Access is personal to the approved user or organization and must not be shared outside that organization. We may change, limit, suspend or end beta access and features at any time. The beta has no service-level agreement, production-availability commitment or guaranteed retention period.
2. Your workspace and data
You are responsible for your account, organization members, API keys, monitor configuration and external integrations. Only add systems, endpoints, credentials and data that you are authorized to use. You must not use Failsafe to monitor a third party without authority, interfere with the service, probe systems unlawfully, evade access controls or attempt to access another organization's information.
3. Monitoring and alerts
Failsafe helps observe systems and send notifications; it does not guarantee that every failure is detected, that a notification is delivered, or that a service will recover. Do not use it as the sole safeguard for emergency, life-critical, safety-critical or other situations where a delayed or missed alert could cause harm. You remain responsible for your own monitoring, escalation and incident-response decisions.
4. Public pages and third parties
Your workspace controls the content it publishes on a public status page and the destinations it configures, including Discord and webhooks. You are responsible for ensuring that this content and those disclosures are lawful. We may remove or disable content or access where it creates a security, legal or operational risk.
5. Feedback and intellectual property
You retain your rights in the content and configuration you provide. You give us the limited right to process it only to operate, secure and improve the beta. Feedback is welcome; you allow us to use it without compensation or obligation to improve Failsafe. Failsafe, Asta and their product materials remain protected by applicable intellectual-property law.
6. Suspension and ending access
You can stop using the beta at any time. We may suspend or end access if necessary for security, legal compliance, operational reasons or a breach of these terms. Contact us before ending access if you need to arrange retrieval or deletion of workspace data during the beta.
7. Liability
Failsafe is supplied as a beta. To the extent permitted by law, liability for ordinary negligence is excluded except for the breach of an essential contractual obligation; in that case, liability is limited to foreseeable damage typical for this type of agreement. Nothing in these terms limits liability for intent, gross negligence, injury to life, body or health, fraudulent concealment, an expressly assumed guarantee or mandatory liability under German law.
8. Privacy, law and changes
Our handling of personal data is described in the Privacy notice. German law applies where legally permitted; mandatory consumer-protection law remains unaffected. We may update these terms as the beta develops. For material changes, we will make reasonable efforts to notify the beta contact before they apply. Questions can be sent to [email protected].
